The Justice Department is pushing to revive criminal charges against Kilmar Abrego Garcia. In a filing with the 6th U.S. Circuit Court of Appeals on late Monday, prosecutors say U.S. District Judge Waverly Crenshaw erred when he found the human smuggling charges were an “abuse of prosecuting power.” Abrego Garcia’s successful challenge of his 2025 deportation to El Salvador was an embarrassment for the Trump administration. The government only returned him to the U.S. after they had secured a criminal indictment. Crenshaw found that both the timing of the charges and statements by top Justice Department officials suggested a prosecution tainted by animus toward the defendant.

At this scale the government has effectively infinite resources so there isn't much of a downside to never admitting wrongdoing and keeping it going. The base gets red meat out of it too, as Fox News will continue to insist he's an MS-13 human trafficker and hobbyist Satan worshipper.

When the Trump administration accused David Hearn, it revealed that they have NO hesitation targeting ordinary citizens when it serves their agenda.

When truth becomes inconvenient, they pick a citizen, invent a villain, and count on the wreckage to advance their interests.

This is an administration willing to inflict real harm on ordinary people to protect it’s power.
