Not in your top 100 Trump evil acts: DOJ wants to protect Elon+bros from all pollution damages because AI is "national security policy". Elon did Mississippi/Memphis dirty.

Trump's DOJ would probably intervene in all other objections to datacenter projects, at least on appeal, if oligarchs lose anything.

National Security vs. Clean Air: The Legal Battle Over Musk’s Memphis Supercomputer

MEMPHIS, TN — A fierce legal battle is unfolding in federal court over Elon Musk’s xAI "Colossus" supercomputer facility, illuminating a stark conflict between local environmental protection and federal artificial intelligence policy. What began as a local dispute over unpermitted pollution has escalated into a high-stakes constitutional showdown, following an extraordinary intervention by the U.S. Department of Justice (DOJ).

The Unpermitted Build and Environmental Breaches

In rushing to bring its Colossus 1 and 2 data centers online, xAI and its subsidiary MZX Tech bypassed standard environmental review. The company installed an unauthorized grid of 27 industrial methane gas turbines—effectively building a 495-megawatt power plant without securing mandatory air permits.

The facility severely breaches federal Clean Air Act (CAA) standards. The greater Memphis metropolitan area already fails to meet federal ozone safety limits. Local community groups, spearheaded by the NAACP and Earthjustice, allege that xAI’s unpermitted plant has the potential to pump an industrial torrent of toxic pollutants directly into surrounding neighborhoods every year:

  • 1,700 tons of Nitrogen Oxides (NOx), a primary driver of heavy, localized smog.

  • 180 tons of fine particulate matter (PM2.5), microscopic soot that triggers asthma and cardiovascular distress.

  • 19 tons of formaldehyde, a highly hazardous air pollutant linked to elevated cancer risks.

Because these turbines operate 24/7 next to residential sectors, churches, and schools with predominantly Black populations, the lawsuit seeks an immediate injunction to halt the environmental harm.

The DOJ Intervention: Challenging Legal Precedent

The litigation shifted dramatically when the Trump administration's DOJ filed an aggressive motion to intervene and dismiss the case with prejudice. Associate Attorney General Stanley Woodward Jr. signed a memo asserting that a court-ordered power shutdown threatens national security by choking off the artificial intelligence innovation supporting military operations. (ie. skynet)

In doing so, the DOJ is attempting to dismantle 50 years of environmental legal precedent:

  • Challenging the CAA Citizen Suit Provision: Section 304 of the Clean Air Act explicitly grants private citizens the right to sue corporate polluters to enforce the law when regulators fail to act. The DOJ is arguing that the executive branch has the unilateral, unchallenged authority to veto citizen suits if a private project aligns with federal economic or military goals.

  • Undermining Tennessee Valley Authority v. Hill: This foundational Supreme Court precedent established that the judiciary can halt multi-million-dollar infrastructure projects if they violate federal safety and environmental laws, regardless of economic cost. The DOJ's new defense model argues that "AI Primacy" and sovereign technological dominance legally supersede standard statutory environmental protections.

The government is actively demanding zero operational restrictions and zero financial compensation, establishing a framework where private tech firms are granted legal immunity from localized physical harm if their computing models are labeled vital to the state.

The Political Undercurrent

The unprecedented federal intervention to protect xAI's unpermitted facility coincides with Musk’s massive financial role in the active political landscape. While Musk contributed roughly $250 million to $290 million to help return Republicans to power in the 2024 presidential race, his spending has expanded during the 2026 midterm election cycle.

According to recent disclosures tracked by The New York Times, Musk has quietly funneled a staggering $366 million to Republican groups and candidates during the 2025–2026 cycle. This includes a $158 million single donation to the Senate Leadership Fund and over $76 million pumped directly into his America PAC to build sprawling voter-turnout operations.

As the largest individual private donor in modern American history, Musk's financial weight forms the backdrop of the federal government's legal defense, leaving local communities to pay the price in the air they breathe.

Discussion of climate, how it is changing, activism around that, the politics, and the energy systems change we need in order to stabilize things.

As a starting point, the burning of fossil fuels, and to a lesser extent deforestation and release of methane are responsible for the warming in recent decades: Graph of temperature as observed with significant warming, and simulated without added greenhouse gases and other anthropogentic changes, which shows no significant warming

How much each change to the atmosphere has warmed the world: IPCC AR6 Figure 2 - Thee bar charts: first chart: how much each gas has warmed the world. About 1C of total warming. Second chart: about 1.5C of total warming from well-mixed greenhouse gases, offset by 0.4C of cooling from aerosols and negligible influence from changes to solar output, volcanoes, and internal variability. Third chart: about 1.25C of warming from CO2, 0.5C from methane, and a bunch more in small quantities from other gases. About 0.5C of cooling with large error bars from SO2.

Recommended actions to cut greenhouse gas emissions in the near future:
