Christa Pike out of hospital and back in prison after botched execution attempt

a day ago by MicroWave to c/news

Pike’s lawyers said she is back in same prison she’s lived in for last 30 years and will continue to receive medical care

Christa Pike has been discharged from the hospital after surviving Tennessee’s botched 30 September attempt to execute her by lethal injection and is back in prison, her lawyers said on Saturday.

Saturday’s update about Pike came 10 days after the death row prisoner was given two doses of pentobarbital, a lethal injection drug, in what proved to be a failed execution attempt. She was hospitalized after surviving the botched execution and was declared brain dead on Monday.

But in a shocking turnaround, on Thursday her lawyer said that she was “up and walking” – though she remained “somewhat foggy” and wasn’t able to use her arms very much.

Pike said that her arms were burning during the failed execution and asked if it was supposed to feel that way. Witnesses present in the chamber said that “nothing was normal” while officials have maintained that they followed every step of Tennessee’s approved execution protocol.

how can someone be declared brain dead and then wake up the next day with no mayor neurological damage?
were they trying to finish the job by disconnecting her from life support?

I'd imagine so, yes. Clean up the loose ends as it were. Trying, twice, to kill someone and having them still walking around is rather embarassing after all.

The thing is that no doctors are involved in the executions. They take the Hippocratic Oath so they swear to not willingly do harm. The people doing these executions are usually prison staff that have no medical training.

The Hippocratic oath also includes a promise not to perform surgery, and to leave that to surgeons:

I will not use the knife, not even, verily, on sufferers from stone, but I will give place to such as are craftsmen therein.

Gets broken every day.

That's the original ancient oath. There are modernised versions. As of 2018, all US medical school graduates made some form of public oath but none used the original Hippocratic Oath. A modified form or an oath unique to that school is often used.

I've heard this is why death sentences state "hanged by the neck until dead." Someone survived a hanging at one point and successfully argued that their sentence had been carried out, so they could not be hanged again. I read about it years ago, I don't remember details. All this is to say she might not be able to make that point. Either way, you're right. It's gonna be interesting.

Not really. Despite the tails you hear about people saying they were dead and came back after seeing heaven, and saying stuff like they had a heart attack and died three times on the way to the hospital, those aren’t dead. Do you think any of those cases would be willing to send all their stuff off to whoever is inheriting it? The laws know this and the sentence is not going away on a gotcha. Otherwise people with life sentences or on death row would be trying to give themselves survivable heart attacks all the time. Not a fan of the justice system or the death penalty in general, but this lady is there for a good reason. It may functionally turn into a life sentence but they sure aren’t letting her go free.

Judges usually don't like tricks like trying to argue a definition of death in which the person is alive afterward. It wouldn't be accepted in the other direction either; an assailant whose victim is alive is not guilty of murder.

There are certainly legal arguments against trying to execute her again, but if one succeeds, the outcome will be life in prison, not release.

The prison system is so rotten and corrupt to enrich the few and hurt many. The number of people in prison is deplorable and a sign that the system is rotten to have so many. We can see what helps people out of poverty and crimes and deaths of desperation, but do the opposite too often, so this is the result of that. Unhealthy systems produce unhealthy society and people. All this suffering to enrich industries related to prisons too, like all the concentration camps and supporting businesses in on the violent grift. This is the sickness of doubling down on unhealthy ways.

That's a sign of the injection going a wrong way, namely somewhere else than the vein where it probably was supposed to be. Idk if it happens with just any intravenous injections, but I got exactly that feeling when mine didn't go into the vein.

Bullets are cheap, guillotine is cheap, hanging is cheap. I am pro death penalty. There are truly serious, vile, and wicked evil people in this world. Most of which the common person has no idea the atrocities people commit due to sheltering world views, news under reporting, evil doesn't always get caught, insert reason here...

However. They absolutely should not have done it this way, it's absolutely ridiculous. Lethal injection is not a good execution method. It costs so much money to execute someone, and for zero reason when other methods are cost effective and more efficient. Life in prison is a major cost year over year and should be used in limited circumstances. This lady has health reasons that were ill considered for the type of execution attempted. Overall just a terrible situation.

In this day and age of cameras everywhere and dna testing. Yes, you can 100% guarantee that some people have committed the crime. The problem become between 'beyond a reasonable doubt' and 100%. Examples: Gary Ridgeway, Ted Bundy, Ed Gein. (But hey, according to you they might be innocent, let's give them a standard of living better than the poor in our society)

Life in prison is cheaper then the death penalty by a wide margin owing to the numerous safeguards in place (e.g. mandatory appeals.) to ensure we murder folks who deserve it.

Beyond that, the death penalty doesn't work as a crime deterrant, murder rates in death penalty states track higher then abolitionist ones.

Lastly, someone getting put to death gains minor celebrity during it, offering a perverse incentive to the especially vile, while life in jail is just quiet fading to nothing over time and maybe a paragraph after they die saying they're dead. Certainly not the news cycle Pike has gotten.

I could see the death penalty in limited circumstances like the Nuremberg trials, but for someone like Pike, Charles Manson, or whoever? Let 'em rot.

However, like them, you are not "vile and wicked evil", you are broken. Some people are broken like that by biological defects, some by trauma, and some by slow development into a psychopath. Society needs to be protected from some of them, but we have no right to kill, because that would put us on the same level as you or the other psychopaths.

Welcome to the News community!

Rules:

1. Be civil

Attack the argument, not the person. No racism/sexism/bigotry. Good faith argumentation only. This includes accusing another user of being a bot or paid actor. Trolling is uncivil and is grounds for removal and/or a community ban. Do not respond to rule-breaking content; report it and move on.

2. All posts should contain a source (url) that is as reliable and unbiased as possible and must only contain one link.

Obvious biased sources will be removed at the mods’ discretion. Supporting links can be added in comments or posted separately but not to the post body. Sources may be checked for reliability using Wikipedia, MBFC, AdFontes, GroundNews, etc.

3. No bots, spam or self-promotion.

Only approved bots, which follow the guidelines for bots set by the instance, are allowed.

4. Post titles should be the same as the article used as source. Clickbait titles may be removed.

Posts which titles don’t match the source may be removed. If the site changed their headline, we may ask you to update the post title. Clickbait titles use hyperbolic language and do not accurately describe the article content. When necessary, post titles may be edited, clearly marked with [brackets], but may never be used to editorialize or comment on the content.

5. Only recent news is allowed.

Posts must be news from the most recent 30 days.

6. All posts must be news articles.

No opinion pieces, Listicles, editorials, videos, press releases, or celebrity gossip will be allowed. All posts will be judged on a case-by-case basis. Mods may use discretion to pre-approve videos or press releases from highly credible sources that provide unique, newsworthy content not available or possible in another format.

7. No duplicate posts.

If an article has already been posted, it will be removed. Different articles reporting on the same subject are permitted. If the post that matches your post is very old, we refer you to rule 5.

8. Misinformation is prohibited.

Misinformation / propaganda is strictly prohibited. Any comment or post containing or linking to misinformation will be removed. If you feel that your post has been removed in error, credible sources must be provided.

9. No link shorteners or news aggregators.

All posts must link to original article sources. You may include archival links in the post description. News aggregators such as Yahoo, Google, Hacker News, etc. should be avoided in favor of the original source link. Newswire services such as AP, Reuters, or AFP, are frequently republished and may be shared from other credible sources.

10. Don't copy entire article in your post body

For copyright reasons, you are not allowed to copy an entire article into your post body. This is an instance wide rule, that is strictly enforced in this community.
